الحق في النفاذ الى المعلومة وحوكمة الإدارة العمومية في الجزائر

Résumé: تعالج هذه الدراسة أهمية تبني مفهوم الحوكمة كإطار لتحسين أداء الإدارة العمومية في الجزائر مع تسليط الضوء على حق النفاذ إلى المعلومة كأداة أساسية لتعزيز الشفافية والمساءلة والمشاركة. ويُعتبر هذا الحق ركيزة أساسية لضمان فعالية الإدارة وتوجيه السياسات العامة بما يخدم المصلحة العامة في الدولة، إضافة إلى ذلك يتيح هذا الحق للمواطنين الاطلاع على المعلومات الحكومية مما يعزز من مشاركتهم في اتخاذ القرارات ويحفزهم على مراقبة الأداء العام، وعلى الرغم من أهميته البالغة إلا أن تطبيق هذا الحق يواجه تحديات عديدة تتعلق بالبيروقراطية وثقافة السرية الإدارية ونقص البنية التحتية الرقمية. في هذا السياق تهدف الدراسة إلى تحليل العلاقة بين حق النفاذ إلى المعلومة وحوكمة الإدارة العمومية، فضلاً عن استكشاف الحلول الممكنة لتعزيز فعاليته. Abstract: This study addresses the importance of adopting the concept of governance as a framework to improve the performance of public administration in Algeria, highlighting the right of access to information as an essential tool to enhance transparency, accountability and participation. This right is considered an essential pillar to ensure the effectiveness of the administration and direct public policies to serve the public interest in the state. In addition, this right allows citizens to access government information, which enhances their participation in decision-making and motivates them to monitor public performance. Despite its great importance, the implementation of this right faces many challenges related to bureaucracy, the culture of administrative secrecy, and the lack of digital infrastructure. In this context, the study aims to analyse the relationship between the right of access to information and the governance of public administration, as well as explore possible solutions to enhance its effectiveness.
