الخطورة الإجرامية وأثرها في تقدير العقوبة البديلة في التشريع الجنائي الفلسطيني

Résumé: ملخص: تناولت هذه الدراسة مفهوم الخطورة الإجرامية وأثرها في تقدير العقوبة البديلة حيث وقفت على حقيقة هذه الخطورة وكيفية تحديدها من خلال بعض الظواهر التي تدل عليها كالجريمة السابقة، وتبين لها ان العقوبة البديلة هي عقوبة تضمنتها السياسة الجنائية الحديثة وتختلف عن التدابير الاحترازية، حيث ظهر أن لهذه الخطورة الإجرامية أهمية وارتباطا بالعقوبة من حيث التأثير في فرض الجزاء الجنائي، ومدى اعتبارها معيارا في تقدير العقوبات البديلة لما لذلك من دور في الكشف عن مدى الخطر المرافق للسلوك المجرم، الذي يظهر من خلال ما يكمنه الجاني في نفسه قبل ارتكاب جريمته، ولهذه الأسباب المؤثرة في تحديد مقدار العقوبة جاءت هذه الدراسة لإظهار الرابطة بين هذه الخطورة الكامنة والعقوبة البديلة وفقا لطبيعتها القانونية بناء على تفصيلات وردت في الدراسة. Abstract: In the light of the development of the criminal policy and the adoption of some legislations for alternative punishments besides the traditional penalties to strengthen the objectives of the punishment in deterrence, reform and rehabilitation, the present study examines the importance of criminal severity and its connection with punishment in terms of the effect on imposing a criminal sanction, and the extent to which it is considered a criterion in assessing alternative penalties because of their role in revealing the extent of the danger that accompanies the criminal’s behavior For these reasons and the importance of criminal risk in determining the amount of punishment, we seek to show the link between this inherent criminal seriousness and the alternative punishment according to its legal nature.. This risk is shown by what the perpetrator lies in himself before committing his crime.
