مكانة الخطورة الإجرامية في التشريع الجنائي

Résumé: يستهدف المشرع الجنائي حماية المجتمع بوضع نصوص تواجه خطورة المجرم، التي لا تنحصر فيما يمكن أن يقع من جرائم بالنسبة لأشخاص سبق لهم إرتكاب أفعال مجرمة وتوافرت لديهم خطورة إجرامية، وإنما أيضا بالنسبة لأشخاص لم يقترفوا جرائم بعد، وإنما تنذر حالتهم بأنهم سيرتكبون جرائم في المستقبل، طالما أن الخطورة هي حالة تتعلق بالشخص يصبح معها مصدرا محتملا للجرائم، لذلك فإنها قد تثبت دون إرتكاب الشخص للجريمة، كما انها قد تثبت أثناء وبعد إرتكاب الجريمة، فلا يلزم أن ينحصر وجود الخطورة الإجرامية في الشخص الذي أجرم بالفعل دون سواه، فقد تتوافر حتى في الشخص الذي لم يرتكب جريمة بعد، وإنما يحتمل بسبب وجودها فيه أن يرتكب جريمة، وبالتالي فإن للخطورة الإجرامية دور في خلق نماذج أو صور التجريم، كما يتوقف عليها أيضا تحديد نوع الجزاء ومقداره. الكلمات المفتاحية: الحماية، المجرم، الخطورة، الجرائم. Abstract: The criminal legislator aims to protect society by setting texts that face the danger of the criminal, which is not limited to the crimes that may occur in relation to people who have previously committed criminal acts and have a criminal risk, but also in relation to people who have not committed crimes yet, but rather their condition warns that they will commit crimes in the future, As long as the danger is a condition related to the person who becomes with it a potential source of crimes, so it may be proven without the person committing the crime, and it may also be proven during and after the commission of the crime. The person who has not yet committed a crime, but is likely to commit a crime because of its presence, and therefore the criminal risk has a role in creating models or images of criminalization, and it also depends on determining the type and amount of the penalty.
