دور الأدلة الرقمية في الإثبات الجنائي

Résumé: كشفت الثورة المعلوماتية التي شهدها العالم في العصر الحديث عن ظهور ادلة علمية حديثة ذات طبيعة تقنية، مستخلصة من اجهزة الحاسب الالي وملحقاته او شبكة الانترنيت وكل جهاز اخر له خاصية المعالجة او تخزين المعلومات اطلق عليها "الادلة الرقمية" تتمتع بالدقة والموضوعية التي تجعلها دليلا حاسما ويقينيا في الاثبات الجنائي، غير ان الطابع غير المرئي لهذه الادلة سهل لمرتكبي الجرائم المعلوماتية امكانية تشفير البيانات او اتلافها او محوها او اخفائها للحيلولة دون الوصول للدليل، ويخضع الدليل الرقمي كغيره من ادلة الاثبات الاخرى للسلطة التقديرية للقاضي الجزائي. Abstract: DNA is the most important means of scientific evidence revealed by modern biological developments. It surpassed other criminal evidence in terms of accuracy and objectivity of its results. And has approved the legitimacy of most national legislation and international conferences and regional judicial applications revealed that the results are decisive evidence in proving many crimes such as killing, rape and others. Yet remains as a presumption in some cases where the fingerprints are multiple in the crime scene.Whereas it can be the strongest evidence if supported by other evidence, which was the judicial applications in most courts in the world.
