أثر استحداث المحكمة الإدارية للاستئناف للجزائر العاصمة على منازعات إلغاء قرارات سلطات الضبط الاقتصادي

Résumé: استجابة لآمال المتقاضين في المجال الإداري و لتوصيات الفقه القانوني واستكمالا لمسار الإصلاح القضائي الذي شرعت فيه الجزائر منذ 1996، تم إنشاء المحاكم الإدارية الاستئنافية و ذلك بمقتضى التعديلات الأخيرة بدءا من التعديل الدستوري لسنة 2020، ليكتمل بذلك بناء الهيكل القضائي الإداري. لقد حملت هذه الإصلاحات تعديلا في قواعد الاختصاص وذلك بالنسبة لمنازعات قرارات سلطات الضبط الاقتصادي، من اختصاص ابتدائي نهائي لمجلس الدولة إلى اختصاص ابتدائي للمحكمة الإدارية الاستئنافية للجزائر العاصمة. تهدف هذه الدراسة إلى تسليط الضوء على الآثار القانونية المترتبة على استحداث هذه المحكمة وبيان مدى فعاليتها سواء بالنسبة لقواعد الاختصاص الممنوح سابقا لمجلس الدولة، أو على مبادئ السير الحسن للعدالة الإدارية. Abstract: In response to the hopes of administrative litigants and the recommendations emanating from legal doctrine ; and to accomplish the judicial reform process initiated by Algeria since 1996, the Administrative Courts of Appeal are established pursuant to the recent amendments starting from 2020 Constitutional Amendment, thus completing the construction of the administrative judicial structure. These reforms have amended the jurisdictional rules with regard to diputes concerning economic regulatory authorities decisions, where the Council of State was competent at first and final instance. Instead the Administrative Court of Appeal in Algiers becomes the first instance for litigation. This study aims to highlight the legal consequences of the establishment of this Court and illustrate the extent of its effectiveness.
