رقابة مجلس الدولة على السلطة القمعية لهيئات الضبط الاقتصادي، مالجديد؟ في ظل التعديلات التي عرفتها منظومة القضاء الاداري

Résumé: كان مجلس الدولة هو المختص بالرقابة على السلطة القمعية لهيئات الضبط الاقتصادي، باعتبارها هيئات إدارية وطنية، ولطالما أنتقد الأمر لأنه يعصف بمبدأ التقاضي على درجتين لأن مجلس الدولة كان يفصل في دعاوى الإلغاء بموجب قرارات ابتدائية ونهائية، هذا ما جعل المؤسس الدستوري يعيد هيكلة القضاء الإداري بإنشاء المحاكم الإدارية للاستئناف، ليأتي المشرع ويحيل للمحكمة الإدارية للاستئناف لمدينة الجزائر تلك الاختصاصات التي كانت مخولة لمجلس الدولة كقاضي أول وآخر درجة، والتي تفصل فيها بموجب أحكام ابتدائية قابلة للاستئناف أمام مجلس الدولة، مما يشكل قفزة إيجابية لصالح الأعوان الاقتصاديين، بتكريس مبدأ التقاضي على درجتين في القرارات الصادرة عن هيئات الضبط القطاعية. The State Council was tasked with overseeing the repressive authority of economic regulatory bodies, given that they are national administrative bodies. This was criticized as conflicting with the principle of dual jurisdiction, where the State Council would rule on cancellation claims bases on primary and final decisions. This led the constitutional founder to restructure the administrative justice system by establishing specialized administrative courts of appeal. The legislative body then referred the power to appeal to the Administrative Court in Algiers, where these competencies were previously granted to the State Council as both a first and final judge. This created a qualitative leap in favor of economic officials by institutionalizing the principle of dual jurisdiction for decisions issued by sectoral regulatory bodies
