دور الموثق في تكريس الحماية التي أقرها المشرع للمقتني في عقد البيع على التصاميم

Résumé: حظي عقد البيع على التصاميم من حيث تنظيمه القانوني بعناية خاصة من المشرع لكونه يبرم بين طرف محترف وآخر ضعيف، لذا حرص المشرع على حماية هذا الأخير بشتى الطرق، ومن صور ذلك أنّه أوكل مهمة إبرام العقد إلى شخص ثالث خارج عن العقد هو الموثق، وبما أن عقد البيع على التصاميم هو عقد شكلي، وله نموذج خاص يحتوي على الشروط والالتزامات والحقوق التي أقرّها المشرع لحماية المقتني، فإنّ دور الموثق يبرز أكثر في تكريس هذه الحماية من خلال حرصه على احترام هذا النموذج وما يحتويه من شكل ومضمون، ومنه إبرام عقد متوازن وفق توجّه غاية المشرّع. The legislator has therefore sought to protect the latter in various ways, such as the fact that he has entrusted the task of concluding the contract to a third person outside the contract, who is the notary, Since a sales contract on designs is a form contract, it has a special model containing the conditions, obligations and rights established by the legislator to protect the acquisition, The role of the notary is further highlighted in the dedication of this protection through its concern to respect this model and its form and content, One is to conclude a balanced contract according to the purpose of the legislature.
