حق المستهلك الالكتروني في العدول في التشريعين الجزائري والمغربي

Résumé: منح كل من المشرعين الجزائري والمغربي للمستهلك الالكتروني خيارا يمكنه من الرجوع في العقد الذي أبرمه خلال مدة معينة، لهذا كان الهدف من هذه الدراسة هو إزالة اللبس عن الأحكام التي يقوم عليها حق العدول في عقد الاستهلاك الالكتروني، وتوضيح الاجراءات التي يتبعها المستهلك لممارسة هذا الحق، وتبيان الآثار المترتبة عنه، في كل من التشريعين الجزائري والمغربي. غير أن المشرع المغربي كان أكثر حماية للطرف الضعيف في العقد، أي المستهلك الالكتروني، من خلال منحه ضمانات حقيقية من أجل تفعيل حقه في العدول، بينما كان قانون التجارة الالكترونية الجزائري أقل حماية، بالإضافة إلى نقص المواد التي تنظم هذا الحق، إذ اقتصرت على مادتين مقتضبتين فقط. كلمات مفتاحية: المستهلك الالكتروني، حق العدول، التجارة الالكترونية، العقد الالكتروني. Both of the Algerian and Moroccan legislators grated the electronic consumer an option that enables them to refer to the contract that was concluded during a certain period, for this, the purpose of this study was to remove confusion on the provisions on which the right to withdraw in the electronic consumption contract is based and to clarify the procedures that the consumer follows to exercise this right and the effects arising from it in both the algerian and moroccan legislation. However, the the Moroccan legislator was more protective of the weak party in the contract, that is, the electronic consumer, by giving him real guarantees in order to activate his right to justice, while the Algerian electronic commerce law was less protected, in addition, to the lack of articles that regulate this right, as it was limited to only two brief articles.
