المحاكم التجارية المتخصصة في الجزائر في ظل القانون 22-13

Résumé: تعتبر المحكمة التجارية المتخصصة المنصوص عليها في القانون رقم : 22-13 المعدل والمتمم للقانون رقم: 08- 09 والمتضمن قانون الإجراءات المدنية والإدارية آلية قضائية لتسوية المنازعات التجارية المحددة حصرا على غرار القسم التجاري، حيث عمل المشرع الجزائري على تنظيمها في القسم الثاني من الفصل الرابع في المواد من536 مكرر إلى 536 مكرر 7 من ذات القانون، وكذا في المرسومين التنفيذيين وهما على التوالي المرسوم رقم: 52-23- المحدد لشروط وكيفيات اختيار مساعدي المحكمة التجارية والمرسوم رقم : 23-53 المحدد لدوائر الاختصاص الإقليمي للمحاكم التجارية المتخصصة. لذلك تعالج هذه الدراسة النظام القانوني للمحكمة التجارية المتخصصة وفق النصوص التشريعية والتنظيمية المتعلقة بها، والتي جاءت لتكريس القضاء التجاري المتخصص وتعزيز مناخ الأعمال. الكلمات المفتاحية : المحكمة التجارية المتخصصة، القسم التجاري، المنازعات التجارية، القضاء التجاري. ABSTRACT : The Specialized Commercial Court provided for in Law No. 22-13 amending and supplementing Law No. 08-09 containing the Code of Civil and Administrative Proceduresis a judicialmechanism for settlingexclusivelyspecific commercial disputes, similar to the commercial section, as the Algerian legislator has worked to regulateit in the second section of Chapter IV in articles 536 bis to 536 bis 7 of the samelaw, as well as in the twoexecutivedecrees, respectivelyDecree No. 52-23 - Determining the conditions and modalities for the selection of assistants to the Commercial Court and Decree No. 23-53 specifying the regionaljurisdictiondepartments of the specialized commercial courts. Therefore, thisstudy deals with the legal system of the Specialized Commercial Court in accordance with the legislative and regulatorytextsrelated to it, which came to devote the specialized commercial judiciary and enhance the business climate.
