المحاكم التجارية المتخصصة -مستجدات الوساطة في المادة التجارية على ضوء القانون رقم 13/22المعدل والمتمم لقانون الإجراءات المدنية والإدارية

Résumé: الملخص: إن تشعب المنازعات التجارية جعلها تأخذ عدة أشكال غير تقليدية ، لذلك قام المشرع الجزائري بإعادة النظر في النظام القضائي التجاري باستحداث المحاكم التجارية المتخصصة من خلال تعديل قانون الإجراءات المدنية والإدارية رقم 08-09 بموجب القانون رقم 13/22 المؤرخ في 12/07/2022 ، و في إطار السعي لحل المنازعات التجارية وديّا أدرج إجراء الصلح لدى تلك المحاكم و الذي أصبح إجراء جوهريا قبل قيد الدعوى لديها ، ودعم المشرع إجراء الوساطة بأحكام جديدة تسمح بتفعيلها. Abstract : The complexity of commercial disputes made them take several unconventional forms, so the Algerian legislator reconsidered the commercial judicial system by creating specialized commercial courts by amending the Civil and Administrative Procedures Law No. 08-09 pursuant to Law No. 22/13 dated 07/12/2022, and within the framework of seeking to resolve commercial disputes amicably, the legislator included the conciliation procedure at Those courts which has become an essential procedure before the case is registered with it, and supported the mediation procedure with new provisions that allow its activation.
