Résumé: ملخص: تُعتبر العقوبة الدولية النتيجة الحتمية عند ثبوت المسؤولية الجنائية الدولية للأفراد، ويُلاحظ أن النظام الأساسي للمحكمة الجنائية الدولية انتهج سياسة عقابية أكثر وضوحًا مقارنة مع المحاكم الدولية السابقة، الأمر الذي يُمكن اعتباره تحوّلًا جذريًّا في القانون الدولي الجنائي، لكن ما مدى مساهمة القضاء الدولي الجنائي في تحديد العقوبة الدولية ؟ إن هدف هذه الدراسة تحديد مفهوم العقوبة الدولية وكيفية تقريرها اعتمادًا على منهج تحليلي في نقد النصوص ومنهج وصفي في البيان ومنهج مقارن للقواعد والأحكام، وخلصنا بنتائج أهمها أن النظام الأساسي للمحكمة الجنائية الدولية بيّن بدقة أنواع العقوبات وسلطة تخفيضها، وحدّد القواعد الخاصة بالإعفاء من العقاب وتقادم العقوبة. Abstract: International punishment is the inevitable result when the international criminal responsibility of individuals is proven. It is noted that the Statute of the International Criminal Court has adopted a clearer punitive policy compared to previous international courts, which can be considered a radical shift in international criminal law, But what is the extent of the contribution of the international criminal judiciary in determining the international punishment ? The aim of this study is to define the concept of international punishment and how to determine it, relying on the analytical approach in criticizing texts, the descriptive approach in the statement, and the comparative approach between rules and provisions, and we concluded with results, the most important of which are: that the Statute of the International Criminal Court accurately clarifies the types of penalties and the authority to reduce them, and specifies the rules for exemption. punishment and statute of limitations.
