الاختلاف الفقهي عند متأخري المالكية The Controverrsy In The Jurisprudence( Fiqh) Of The Late Maliki

Résumé: الملخص: كثرة الاختلاف الفقهي في المذهب المالكي أمر لا يختلف فيه اثنان، وهو محمدة لا منقصة، تمثل ما عليه المذهب المالكي من الثراء الفقهي نتيجة كثرة الأئمة النظار، وتعكس الحرية المطلقة لدى شيوخ وعلماء المذهب. والبحث المقدم دراسة للاختلاف الفقهي في مرحلة من أخطر مراحله، تبين ما للمذهب المالكي من قدرة على مسايرة جميع الفترات التي مر بها، وتعكس قدرته على الاستمرارية وفق صور مختلفة نتيجة الظروف الزمانية والمكانية الملابسة، مما يمنح الفقيه المالكي المعاصر مساحة أوسع لضبط المسائل المعاصرة وفق بيئته الفقهية ومستجدات زمانه. Astract:There is a great controversy of jurisprudence in the maliki doctrine which is reveald througt its richness resulting froum the large imams principals and reflecting the absolute freedom of the elders and scholars of the doctrine ’And the period of the late malikis –after the death of ibn abi zayd al-Qirwani(«381 hijri) –to this day wintnessed a large part of this juirisprudential difference’ and is a period that can be divided into two main rols: All of the above reflect that the diffrence in jurisprudence did not stop at a period of the history of the doctrine but it was taking different images due to the temporal and spatial conditions in place.
