سلامة الأغذية وجودتها:خطوط توجيهية لتقوية النظم الوطنية للرقابة على الأغذية

Résumé: إن قانون حماية المستهلك وقمع الغش والقوانين التي تلته رتّبت التزامات على المهني قبل الإقدام على عرض المنتج للاستهلاك وذلك لتأكيد حماية المستهلك، فقد نجم عن الإنتاج الكبير احتمال متزايد لإفلات بعض السلع من رقابة المنتجين لتخرج إلى السوق مشوبة ببعض العيوب التي يكون استعمالها واستهلاكها محفوفا بالأخطار. وطبقا لإحدى الإحصائيات الرسمية، ثبت أن مجموع الحوادث التي تسببها المنتجات الغذائية سنويا في فرنسا هو5.150.000 حادثة يترتب عليها 24.800 حالة وفاة. فعرض هذه المواد في السوق يجعل الحوادث أمرا مألوفا فهناك بعض المنتجات التي بطبيعتها خطيرة، ولحماية المستهلك ضد المنتوجات الخطيرة تدخل المشرع لفرض بعض الالتزامات على المنتجين فمثلا النصوص المتعلقة بالمطابقة بمعنى المنتوج الذي يشكل خطرا ولم يستجب للرغبة المشروعة المقصودة منه لكن إذا كانت صحة وسلامة المستهلك في خطر فهذه النصوص لا تكفي فالقيم التي يجب الحفاظ عليها (الصحة والسلامة الجسمانية للمستهلك) لا تقارن مع مجرّد أهداف اقتصادية، وصحة المستهلك تستلزم قواعد أكثر صرامة. Abstract: The Consumer Protection and Fraud Suppression Law and the laws that followed created commitments on the professional before offering the product for consumption in order to ensure consumer protection. Large production resulted in an increased possibility for some goods to escape the control of producers to come out to the market tainted by some defects whose use and consumption is fraught with dangers. According to one of the official statistics, the total number of accidents caused by food products annually in France has proved to be 5,150,000, resulting in 24,800 deaths. Displaying these substances on the market makes accidents familiar. There are some products that are inherently dangerous, and to protect consumers against dangerous products, the legislator intervenes to impose certain commitments on producers. For example, the provisions on conformity with the meaning of the product, which poses a risk, has not responded to its legitimate intention, but if the health and safety of the consumer is at risk, these texts are insufficient, the values that must be maintained (Consumer physical health and safety) are not compared to mere economic objectives, and consumer health requires stricter rules.
