رفع الملام عن الامام ابن حبيب(ت238ه) بنماذج فقهية من مخالفته للسّادة المالكية

Résumé: يُعنى هذا البحث ببيان أهمية الامام ابن حبيب ومنزلته العلمية داخل المذهب المالكي خصوصا وخارجه عموما، وذلك بمحاولة رد الشبه الباطلة المكذوبة عليه، حيث اتُّهم بتعصبه للمذهب، مما جعله يضع الأحاديث لنصرته عمدا !، واتهم تارة أخرى بالكذب فيما يرويه عن الإمام مالك !، فحاولنا بيان المغالطات المتعمدة في هذه الاطروحات من خلال دراسة بعض المسائل الفقهية وآراء ابن حبيب فيها. وقد أسفرت نتائجُ البحث، إلى صدق ما ذكره كثير من العلماء عن ابن حبيب، من كونه كان شديد العناية بآراء مالك فيما وافق فيه الحق، ولكنه كان متحررا، لا يدَّخرُ جهدا في نصرته للحق الذي يراه، ولو خالف بذلك إمام مذهبه. Abstract: This research is concerned with explaining the importance of Imam Ibn Habib and his scholarly status within the Maliki school of thought in particular and outside it in general, by trying to respond to the false and false suspicions against him, as he was accused of his intolerance to the Maliki school of thought, which made him intentionally fabricate hadiths to support him! We tried to explain the deliberate fallacies in these treatises by studying some jurisprudential issues and Ibn Habib's views on them. The results of the research resulted in the truth of what many scholars mentioned about Ibn Habib, that he was very careful about Malik's views in what he agreed with the truth, but he was liberal, sparing no effort in his victory for the truth that he saw, even if he contradicted the imam of his school.
