النفقة وأثر تخلفها على مصلحة المحضون
Résumé: إن جريمة الامتناع عن دفع النفقة ونتيجة مساسها بالنظام الأسري كونها تؤدي إلى الاخلال بالحياة الأسرية والنهوض بواجباتها واستلزم لقيامها توافر الأركان العامة المتمثلة في الركن الشرعي والركن المادي والركن المعنوي، بالإضافة إلى الأركان العامة للمشكلة لها إذا تستدعي وجود حكم قضائي نافذ وعلم المتهم عن تسديد النفقة لمدة شهرين وحدد المشروع الجزائري العقوبات الخاصة بمرتكبي هذه الجريمة التي تعتبر كأثر سلبي وبينها في المادة 331 ق ع التي أحالها إلى المادة 14 من هذا القانون. الكلمات المفتاحية: - حاضنة – محضون – صندوق النفقة – الاستفادة - حالات الترجمة للغة الأجنبية: ABSTRACT : the crime of refraining from paying alomong of result of its prejudice to the family system, as it lead to distruption of family life and advancement of its duties, and for its implementaion it requires the availability of the general pillars represented in the legal corner, the material corner and the moral element in addition to the special elements fomed for it if requiresthe escistence ou eschausted judicial ruling and the accused’s knowledge of paying the alimong for a period for aperiod of two months, the algerian legislator specified the penalties for pepretrotos of this crime, which is considered to be negative, among then in article 331 of the penal code, which he referred to article 14 of this law.
