الترخص العام في فقه مالكية الغرب الإسلامي تخريجا وتنزيلا

Résumé: من المعلوم أن الشريعة الاسلامية واقعية في أحكامها؛ تتميز باليسر والسهولة، رفقا بمجموع المكلفين ، ولهذا حرصت على تشريع الرخص عند الضرورات والحاجات العامة. والفقه المالكي ثري بتطبيق الترخص العام في فتاوى النوازل على وجه الخصوص. وهذا الترخص في الفتاوى القديمة يمكن الاستفادة منه للترخص في الحاجات والضرورات العامة العصرية عن طريق التخريج. General License in the Malikite jurisprudence of the Islamic West Inference and application Summary It is known that the Islamic law is realistic in its rulings; it is characterized by ease and simplicity, and compassionate with all legally competents . Therefore it is keen to legislate licenses when necessities and public needs. Maliki's jurisprudence is rich in the application of general license and authorization in the fatwas of calamities in particular. This license in the old fatwas can be used to permit the needs and the general necessities nowdays through inference.
