Résumé: تتجلى أهمية دراسة ظاهرة إزالة تجريم قانون الأعمال في شقيها الموضوعي والإجرائي في مواجهة المد التوسعي للقانون الجنائي للأعمال في ظل تبلور عدة أفكار تنادي بالحق في جزاء غير جنائي في مجال قانون الأعمال يضمن حماية المراكز القانونية للأعوان الاقتصاديين، وهو ما أفرز ظاهرتين للتزاحم والتنافس وفي نفس الوقت للتكامل بين ظاهرتي التجريم وإزالة التجريم بما يتماشى مع التطور المتبادل وما يقدمه من مرونة للسياسة الجنائية في مجال القانون الجنائي للأعمال والتكيف مع حياة الأعمال. إلا أن الأخذ بأحد النظامين لا يمكن أن يكون على إطلاقه، وهو ما يطرح إشكال إيجاد موازنة بين التجريم في المجال الاقتصادي كآلية ردعية لحماية المصالح الاقتصادية للدولة، وإزالة التجريم كبديل لتحقيق الأمن القانوني للأعوان الاقتصاديين؟ The importance of studying the phenomenon of decriminalization of business law is evident in its substantive and procedural aspects in the face of the expansionist tide of business criminal law in the light of the crystallization of several ideas calling for the right to a non-sanctioned sanction.
