الاقتصاد في تنفيذ العقوبة "السوار الإلكتروني نموذجا" Economy In The Implementation Of The Sentence "electronic Bracelet Model"

Résumé: باعتبار أن القانون الجنائي جزء لا يتجزأ من المنظومة القانونية، فإن الاهتمام بتطوير قواعده وفقا لفكر جنائي معاصر، أصبح شغل شاغل للفقهاء والمفكرين في هذا المجال، بل أن هذا الموضوع شتت أذهانهم في سبيل تطوير القاعدة الجنائية، لتصبح أكثر ملائمة لما كانت عليه حيث كانت العقوبة دائما تقابلها السجن مما أنجر عنه في الأخير عدم تحقيق أغراض العقوبة، خاصة منها العقوبات السالبة للحرية قصيرة المدة في تأهيل وإصلاح المحكوم عليه، بل عملت هذه العقوبة على تغذية المجرمين المبتدئين بأفكار الإجرام التي يكتسبونها نتيجة احتكاكهم بأخطر المجرمين في المؤسسات العقابية، إضافة إلى التكاليف الباهظة التي تنفقها الدولة على هذه الفئة- المحكوم عليهم بعقوبات سالبة للحرية قصيرة المدة- والتي تعود بالخسارة على الدولة. ولهذه الأسباب لجأت العديد من التشريعات بما فيهم المشرع الجزائري إلى ابتداع حلول بديلة للعقوبة أو لتنفيذ الجزاء الجنائي، ومن صور هذه الأخيرة فكرة المراقبة الإلكترونية باستخدام السوار الإلكتروني لتفادي مساوئ العقوبة السالبة للحرية قصيرة المدة، حيث يقوم هذا الأسلوب على مراقبة الشخص عن بعد والتأكد من وجوده أو غيابه عن المكان المحدد لإقامته من خلال وجود جهاز مثبت على معصم أو أسفل قدم المحكوم عليه. Considering that criminal law is an integral part of the legal system, the attention of jurists and thinkers in this area to the development of its rules in line with contemporary criminal thought has become a concern for jurists and thinkers, which has distracted in the development of the criminal base so that it better corresponds to what it was. The punishment has always been to punish the perpetrators of criminal offenses who acquire them because of their contacts with the most dangerous criminals in the penitentiary institutions. In addition to the high costs that the state spends for this category - sentenced to sentences for short-term liberty - and the loss of the state. For these reasons, many legislations, including the Algerian legislator, have resorted to the creation of alternatives to punishment or the application of criminal sanctions, among which the idea of electronic surveillance using the electronic bracelet to avoid disadvantages of punishment for short-term freedom.
