اعتبار المآل وأثره في توجيه الفتوى الشرعية

Résumé: الفتوى خلاصة نظر المجتهد؛ وهي الوصفة الشرعية لإصلاح شأن الفرد والمجتمع توقيعا عن رب العالمين، والعالم لا يتحقق من وصف العالمية حتى يكون متمكنا من النظر في مآلات تطبيق فتواه باعتبار المتوقع، مستشرفا النتائج والعواقب. إن المحك في المشروعية أوعدمها في أي اجتهاد تنزيلي هو مستقبل الحكم بعد تنزيله على الواقع؛ فهو الموجه في اتخاذ قرار الإقدام أو الإحجام على فعل معين، هذا العمل الاجتهادي المخصوص، هو المعروف في مقاصد الشريعة ب (النظر في المآلات) . دار هذا البحث على المحاور الآتية: أولا: الفتوى وأصل اعتبار المآل . ثانيا: الفتوى بين اعتبار الحال والمآل مقاربة تأصيلية. ثالثا: قواعد التدبير التنزيلي لأصل اعتبار المآل. Abstract : The Fatwā is the result of ijtihād, and it is the right prescription to fix both individual and society's matters, signed on behalf of the Almighty God A jurist can't reach this grade until he's fully able to look into consequences of his fatwa, as an expectation . The question of any ijtihād's legitimacy is the ability of predicting the judgement after being issued, and how to apply it on reality، This task is known in the Islamic juriprudence as Iʿtibār al-maʾāl . The current research examines the following items: 1. The fatwa and the source of Iʿtibār al-maʾāl. 2. The fatwa between considering the current status and the consequences: Arooting approach. 3. The rules of applying Iʿtibār al-maʾāl.
