تدابير الوقاية والحد من انتشار فيروس كورونا في التشريع الجزائري

Résumé: نظرا لخطورة فيروس كورونا وتأثيراته السلبية على حياة الإنسان، وصحّته من جهة، وعلى واقعيه الاجتماعي والاقتصادي من جهة، ونظرا لخصوصية الأضرار التي سبّبها ولايزال يسبّبها إذ يصعب في بعض الأحيان و يستحيل في أحيان أخرى إعادة الحال لما كان عليه، ونظرا لثبوت انتقال العدوى به ومن ثمّ انتشاره يتّم عن طريق التقارب والاحتكاك بين البشر، اتخذت الجزائر على غرار باقي دول العالم عدّة تدابير وقائية للحيلولة دون وقوع تلك الأضرار ، تضمّنها المرسوم التنفيذي رقم 20/69 والمراسيم والقرارات التي تلته، وبهدف تقييم وتحديد مدى فاعلية تلك التدابير لضمان التباعد الاجتماعي وانعكاساته على ضمان حماية كلّية وفعلية للصحّة العمومية والأرواح البشرية من آثار فيروس كورونا كهدف، والحد من انتشاره كغاية في التشريع الجزائري؟ خصّت بوريقات هذا المقال، ومن خلال دراسة هذه الأخيرة وتحليل مضمونها وفق المنهجين الوصفي والتحليلي، تبيّنت فاعليتها النسبية لأسباب تعود لتقاعس هيئات الضبط الإداري تارة، وعدم استجابة المخاطبين بتلك الآليات تارة، وطبيعة الفيروس تارة أخرى. Due to the seriousness of the Corona virus and its negative effects on human health and life plus the specificity of his damages, It is evident that the transmission of the infection and its spread is through closeness and friction between people, Algeria, like other countries, has taken preventive measures have taken To prevent such damages, it was included in Executive Decree No. 20/69 and the decrees and decisions that followed. And to assess the effectiveness of these measures to ensure social distancing in order to ensure effective protection of public health and human lives from the Corona virus and limit its spread in Algerian legislation? I devoted this article which was studied and analysed according to the descriptive and analytical approaches. The results show its relative effectiveness because of the inaction of the administrative bodies, the lack of response of the addresses and the nature of the virus itself.
