التطبيقات الحديثة لمبدأ التناسب في القضاء الإداري الج ا زئري

Résumé: لقد حاولنا في هذه الدراسة الإجابة على جميع الأسئلة التي قد تثار بشكل علمي وموضوعي في التطبيقات الحديثة لمبدأ التناسب في القضاء الإداري الجزائري بحيث تناولنا في الفصل الأول النظرية العامة لمبدأ التناسب، فقمنا بتعريف مبدأ التناسب وبينا علاقة رقابة التناسب بالأركان الداخلية للقرار الإداري أيضا قمنابتمييزرقابةالتناسبعمايشابهها من المفاهيم القانونية الأخرى، ثم بينا الأساسالقانونيلرقابةالتناسبووسائلهاالقضائية التي يستعملها القاضي الإداري في رقابته على مبدأ التناسب . أما في الفصلالثاني فقمنا بدراسة مجالات تطبيقرقابةالتناسبفيالقضاءالإداريالجزائري بحيث تناولنا تطبيقها فيمجالتأديبالموظفينونزعالملكية وفيمجالالضبطالإداري،بحيث وجدنا أن القضاء الإداري الجزائري وإن كان لم ينكر رقابة التناسب إلا أنه لم تكن له الجرأة الكافية لتطبيق مبدأ التناسب على كل القرارات التي تصدرها جهة الإدارة وخاصة القرارات التي تتعلق بالضبط الإداري التي تحد من حرية الأفراد . In this study we tried to answer all the questions that may be raised scientifically and objectively in modern applications of the principle of proportionality in the Algerian administrative judiciary, so that in the first chapter we dealt with the general theory of the principle of proportionality, so we defined the principle of proportionality and showed the relationship of proportionality control to the internal pillars of the administrative decision as well. Proportionality is similar to other legal concepts, then we showed the legal basis for proportionality oversight and its judicial means that the administrative judge uses in his control of the principle of proportionality. As for the second chapter, we studied the fields of application of proportionality control in the Algerian administrative judiciary, so that we dealt with its application in the field of employee discipline, expropriation and in the field of administrative control, so that we found that the Algerian administrative judiciary, although it did not deny the control of proportionality, was not bold enough to apply the principle of proportionality On all decisions issued by the administration, especially decisions related to administrative control that limit the freedom of individuals.
