إخطار المحكمة الدستورية في الجزائر وفقا للقانون العضوي 22-19

Résumé: تكريس مبدأ سمو الدستور، يعتمد في الأساس على آليات فعلية تندرج ضمن مؤسسة مستقلة، تحمل طابعا قضائيا بقرارات نهائية وملزمة، وهذا ما جسده المشرع الجزائري في التعديل الدستوري لسنة 2020، باستحداث محكمة دستورية حاملة للعديد من الصلاحيات لاسيما مهمتها الرقابية، تتوقف على آلية الإخطار وذلك وفقا للقانون العضوي رقم 22-19، الذي يحدد إجراءات وكيفيات الإخطار والإحالة المتبعة أمام المحكمة الدستورية، حيث أعطى فعالية أكثر، للإخطار المباشر في تبيين قواعد جديدة وإجراءات أكثر دقة، وبغرض تفعيل الرقابة على دستورية القوانين، خص آلية الدفع بعدم الدستورية ضوابط ووضع لها شروط شكلية و موضوعية، ومعرفة كيفية قيام المتقاضين في إثارة عدم دستورية نص تشريعي أو تنظيمي ينتهك حقوقهم وحرياتهم التي يكفلها الدستور. Enshrining the principle of the supremacy of the constitution depends mainly on the actual mechanisms that fall within an independent institution of a judicial nature with final and binding decisions. According to Law No. 22-19, which defines the procedures and methods of notification and referral that must be followed before the Constitutional Court, as it gave more effectiveness to direct notification in defining new rules and more accurate procedures for activating oversight. Concerning the constitutionality of laws, and allocating automatic controls and conditions for them to respond to their unconstitutionality. Formal and objective, knowing how the litigants raise the unconstitutionality of a legislative or regulatory text that violates their rights and freedoms guaranteed by the Constitution
