آلية الإخطار المباشر للمحكمة الدستورية في ظل القانون العضوي رقم 22-19

Résumé: تهدف الدراسة الى تبيان مختلف القواعد الجديدة بإخطار المحكمة الدستورية، وذلك في ظل القانون العضوي الساري المفعول رقم 22-19 المحدد لإجراءات وكيفيات الإخطار والإحالة المتبعة أمام المحكمة الدستورية، حيث أن هذا القانون أعطى آلية الإخطار المباشر فعالية أكثر، سواء من حيث دقة الأحكام أو من حيث الإجراءات التي تميل للطابع القضائي مما يكرس أكثر الرقابة الدستورية. The study aims at clarifying the various new rules that are related to notifying the Constitutional Court, under the organic law applicable under number 22-19, which determines the procedures and modalities of notification and referral followed in front of the Constitutional Court, In fact, this law gave more effectiveness to the direct notification mechanism, either in terms of accuracy of judgement or in terms of procedures that tend to be judicial in nature and this establishes more constitutional censorship.
