اجراءات رفع الدعوى الادارية ( العادية و الاستعجالية )

Résumé: الدعوى هي وسيلة تحريك القضاء لحماية الحق ، و يرى اغلب الفقهاء انها الوسيلة التي خولها القانون لصاحب الحق في الالتجاء الى القضاء لحماية حقه ، و بالتالي فهي سلطة الالتجاء الى القضاء . و من جهة اخرى ، فان الدعوى الادارية ، سواء كانت عادية او استعجالية ، تعتبر دعوى ذات امتياز خاص ، للحصول على تقرير حق او حمايته ، اذ منحها القانون بعض الخصوصيات للارتباطها بالمنازعات التي تكون الدولة او الادارة احد اطرافها . The lawsuit is a means of mobilizing the judiciary to protect the right, and most jurists believe that it is the means authorized by the law to the owner of the right to resort to the judiciary to protect his right, and thus it is the authority to resort to the judiciary to obtain a right determination or protection. On the other hand, the administrative lawsuit, whether ordinary or urgent, is considered a suit of special privilege, as the law gives it some specifics for its connection with disputes in which the state or administration is one of the parties.
