حدود صلاحيات السلطة العليا للشفافية – مقاربة جديدة أم إمتداد للإستراتيجية السابقة في مكافحة جرائم الفساد؟-

Résumé: الملخص: لقد تبنت الجزائر إصلاحات من خلال التعديل الدستوري الأخير خاصة تلك المتعلقة بالوقاية من الفساد ومكافحته، حيث إعتمد المؤسس الدستوري السلطة العليا للشفافية كجهاز يعنى بمكافحة الفساد، بل أكثر من ذلك فقد عزز هذه الأخيرة إذ جعلها ضمن المؤسسات الدستورية الرقابية، وقد واكب المشرع التعديلات الدستورية الأخيرة من خلال إقرار القانون 22-08 المحدد لتنظيم السلطة العليا للشفافية والوقاية من الفساد ومكافتحه وتشكليها وصلاحياتها، التي عززت بصلاحيات رقابية تنسجم مع المكانة الدستورية للسلطة على نقيض الهيئة الوطنية للوقاية من الفساد ومكافحته سابقا التي لا تتعدى صلاحياتها الشق الوقائي ما يتعارض مع تسميها خاصة ما تعلق بعنصر المكافحة ، لذلك يأتي هذا المقال للبحث في مدى حدود السلطة العليا للشفافية. Abstract: Through the recent founding review, the Constitutional Founder sought to reconsider the legal system related to combating corruption, by adopting the Supreme Authority for Transparency, which necessarily abolishes the National Authority for Preventing and Combating Corruption, which was included within the advisory institutions, in contrast to the Supreme Authority for Transparency, which it adopted within the institutions Oversight constitutionalism. The legislator kept pace with the recent constitutional amendments by approving Law 22-08 specifying the organization of the supreme authority for transparency and prevention of corruption, its prevention, formation and powers, which were strengthened with supervisory powers. Therefore, this article comes to examine the extent of the limits of the supreme authority for transparency.
