الضمانات الهيكلية للأمن القضائي في القانون الجزائري

Résumé: يسلط هذا المقال الضوء على الضمانات الهيكلية للأمن القضائي في القانون الجزائري المكرسة لاسيما بموجب التعديل الدستوري لسنة 2020 ونصوصه التطبيقية، وقد توصل المقال إلى أن المشرع الجزائري قد كرس مجموعة من الضمانات الهيكلية للأمن القضائي تنقسم إلى ضمانات تتعلق بتنظيم القضاء وأخرى تتعلق برجال القضاء، أما الضمانات المتعلقة بتنظيم القضاء فإنها تنقسم بدورها إلى ضمانات تتعلق بتنظيم السلطة القضائية كإحدى السلطات الدستورية في الدولة، وضمانات تتعلق بتنظيم جهاز العدالة كمرفق عمومي، كما تنقسم الضمانات المتعلقة برجال القضاء هي الأخرى إلى ضمانات تتعلق بكفاية القضاة وضمانات تتعلق بمسؤولياتهم. This article sheds light on the structural guarantees of judicial security in Algerian law, enshrined in particular in the constitutional amendment of 2020 and its implementing texts. The article concluded that the Algerian legislator has established a set of structural guarantees for judicial security, divided into guarantees linked to the organization of justice, which are divided into guarantees linked to the organization of the judicial authority such as the one of the constitutional authorities of the State, and in guarantees linked to the organization of justice as a public service, and others linked to the magistracy, which are divided into guarantees linked to the competence of judges and other related to his responsibilities.
