Résumé: ملخص : يعد استقلال السلطة القضائية من أهم المواضيع التي أكد عليها التعديل الدستوري رقم 20/442 لتعلقها بشكل مباشر بحقوق وحريات المواطنين، ولتكريس هذه الاستقلالية كان لابد من ضمان حياد القاضي، فلا يحتكم القاضي في ممارسة مهامه إلا للقانون وضميره بعيداً عن أي تدخل خارجي، ولذلك كان لابد من دسترة مبدأ عدم قابلية القاضي للعزل، الذي يعني أنه لا يمكن عزل القاضي أو توقيفه أو نقله أو إحالته للتقاعد إلا من خلال مسائلته بحدود القانون، ومن أهم النقاط التي نص عليها التعديل الدستوري رقم 20/442 هو تشكيلة المجلس الأعلى للقضاء لكونه صاحب الاختصاص بالمسار المهني فإن تشكيلته واستقلاليته عن السلطة التنفيذية تؤثر بشكل أساسي على مبدأ عدم قابلية القاضي للعزل ولكن الإشكال المطروح هو مدى انسجام التشريع الجزائري مع التعديل الدستوري رقم 20/442 . Abstract: The independence of the judiciary is considered one of the most important issues affirmed by the constitutional amendment because of its prejudice to the rights and freedoms of citizens. Therefore, the impartiality of the judge must be guaranteed, as it is not permissible for a judge to be subject to during the exercise of his competencies except to the law and his conscience, and A judge may not be removed, detained, transferred or retired unless he is responsible within the limits of the law. The question, however, is to what extent are Algerian laws compatible with the new constitutional amendment, And the new composition of the Supreme Judicial Council.
