التفوق الحكومي في مجال العمل التشريعي Government Excellence In Legislative Work

Résumé: الملخص إن المبدأ السائد الذي يقضي باختصاص البرلمان بالعمل التشريعي عبر كافة مراحله، بدأ يتراجع خاصة في ظل ازدياد تخل الحكومة في العمل التشريعي، فالحكومة وبحكم امتلاكها لكل الوسائل والامكانيات التي تسمح لها بأخذ نظرة شاملة ودقيقة عن كل النقائص القانونية الموجودة في قطاعاتها الوزارية، أصبحت هي المتحكم الوحيد في مسار العمل التشريعي، ابتداء من المبادرة بالقوانين إلى غاية التصويت والمصادقة على القوانين، وهو ما أدى إلى تراجع دور البرلمان في ممارسة اختصاصه الأصيل، والذي كان له تأثير سلبي على قوة النصوص القانونية المصوت عليها ومصداقيتها عند المخاطبين بها . Summary The prevailing principle that requires the parliament’s jurisdiction in legislative work through all its stages has begun to decline especially, when government intervention has increased in the legislative work . the government, by virtue of the means and possibilities that allow it to take a comprehensive, and accurate view of all the legal shortcomings in its ministerial sectors, has become the only controller of the legislative process, starting with the initiative of the laws, witch led to the decline of the parliament role in practicing its inherent competence, and that had a negative impact on the strength of the legal texts voted and their credibility .
