نازلة التجنس بالجنسية الفرنسية في عهد الاستعمار الفرنسي من خلال فتاوى ابن باديس

Résumé: ملخص: مسألة التجنس بجنسية غير إسلامية من المسائل الشائكة في الحياة المعاصرة، حيث تتعدد صور التجنس وفق اختلاف الظروف و الشروط ، و يترتب عن ذلك اختلاف العلماء في الحكم على المسألة.والبحث يقدم دراسة فقهية لإحدى صور التجنس مرتبطة بظروف الاستعمار الفرنسي في الجزائر ، من خلال مقالات و فتاوى الإمام عبد الحميد ابن باديس حيث تبرز آليات فقهه و اجتهاده وفق معطيات واقع الجزائر الخاص و وفق رؤية مقاصدية لأحكام الشريعة تميز بها المذهب المالكي. الكلمات المفتاحية : التجنس ، الجزائر ، ابن باديس ، الشريعة Abstract: The question of naturalization of non-Islamic nationality is a thorny issue in contemporary life, where multiple forms of naturalization are different according to the different conditions, and this result in the difference of scholars in the ruling on the issue. The research offers a jurisprudential study of one of the forms of naturalization linked to the conditions of French colonialism in Algeria, Articles and fatwas of Imam Abdul Hamid Ibn Badis, where the mechanisms of his jurisprudence are highlighted according to the facts of the reality of Algeria and according to a specific vision of the provisions of the Shari'a distinguished by the Maliki doctrine.
