التكريس الدولي للديون البيئية كآلية لجبر الضرر البيئي

Résumé: تهدف الدراسة إلى معالجة موضوع التكريس الدولي للديون البيئية كآلية لجبر الضررالبيئي الناجم عن الأنشطة الصناعية والاقتصادية للدول الصناعية الكبرى اتجاه دول الجنوب، وذلك انطلاقا من طرح إشكالية عامة تتمحور حول: كيف يمكن تكييف مفهوم الديون البيئية مع متطلبات تحقيق المسؤولية الدولية عن الأضرار البيئية ؟ وظف الباحث المنهج الوصفي التحليلي لتحقيق قراءة علمية وموضوعية لمتخلف الجهود الدولية المحلية في التعامل مع الأضرار البيئية سواء الصادرة عن جهات رسمية أو غير رسمية؛ وكيفية توظيفها لمفهوم الديون البيئية مما يدفع الأطراف المسؤولة إلى البحث عن الأضرار البيئية الناتجة عن الأنشطة ذات المنشأ المسبب للتلوث البيئي ؛ سيما أن العالم يشهد تنامي ملحوظ للظاهرة مما انعكس سلبا على التغيرات المناخية. توصلت الدراسة إلى وجود ارتباط وثيق بين الأضرار البيئية، المسؤولية الدولية، مفهوم الديون البيئية، وبالرغم من حداثة المصطلح على صعيد النقاشات الدولية، بيد أنه يأخذ طريقه بالتدريج لتجسيده على أرض الواقع في إطار ما يعرف بالسياسة الدولية للجباية البيئية تكريسا للمبدأ العالمي الرامي إلى تحقيق تنمية بيئية مستدامة تضمن حقوق الأجيال في الحاضر والمستقبل Abstract : This study aims to address the issue of international dedication to environmental debts as a new mechanism to redress environmental damage resulting from industrial and economic activities from the major industrialized countries towards the countries of the South, based on presenting the following problem: How can the concept of environmental debts be adapted to the requirements of achieving international responsibility for environmental damage? To answer this problem, the researchers employed a descriptive analytical method to achieve an objective scientific reading of the various international and local efforts in dealing with environmental damage, whether issued by official bodies represented by state actors, or informal actors represented by national and international civil society actors, and how they employ the concept of environmental debt. In paying the parties responsible for environmental damage resulting from activities that pollute the environment, especially since our world today is witnessing a remarkable increase in the effects of climate change, which is the most prominent environmental threat and the primary cause of the most important and dangerous environmental damage. The study finally concluded that there is a close connection between environmental damage, international responsibility, and the concept of environmental debt. This concept, despite its novelty in international discussions, has begun to find its way to embodiment on the ground within the framework of international environmental collection policies, given its connection to achieving international responsibility for environmental damage. Resulting from various environmental threats and their impact on the rights of current and future generations to the right to a safe and secure environment.
