خصوصية السؤولية الدولية عن الأضرار البيئية The Privacy Of Interational Liability For Environmental Damage

Résumé: تتناول هذه الدراسة موضوع خصوصية المسؤولية عن الضرر البيئي في جانبها الدولي، فغني عن البيان أن الضرر البيئي ضرر مستقل بذاته له خصائصه الذاتية، التي تجعل منه صعب الإثبات من جهة وآثاره ممتدة عبر الزمان والمكان، ونطاقه أوسع من الضرر العادي أو الضرر المرتد، من هنا تسلط هذه الدراسة الضوء على مسألة الخصوصية التي تنفرد بها المسؤولية الدولية عن الضرر البيئي. فالمسؤولية القانونية حالة الضرر البيئي لم تعد تؤسس كما يراها الفقه التقليدي على ضرورة وجود خطأ وضرر علاقة سببية، بل تطور الأمر نظرا لوجود خطر متعدد تؤسس عليه المسؤولية الدولية عن الضرر البيئي، خاصة مع وجود اتفاقيات دولية وتطبيقات مختلفة للقضاء الدولي، التي أفرزت عن إشكاليات كبيرة عند التعويض عن الضرر البيئي، مما كرس لمفهوم ونطاق جديدين حول المسؤولية الدولية للضرر البيئي. This study deals with the issue of the specificity of liability for environmental damage in its international aspect. It goes without saying that environmental damage is an independent damage that has its own characteristics, which make it difficult to prove on the one hand, and its effects extend through time and space, and its scope is wider than normaldamage or rebound damage, from here This study sheds light on the issue of the specificity of international liability for environmental damage. Legal liability in the case of environmental damage is no longer based, as traditional jurisprudence sees it, on the necessity of a fault and a causal relationship. Rather, the matter has evolved due to the existence of multiple dangers on which international responsibility for environmental damage is based, especially with the existence of international agreements and various applications of international judiciary, which have resulted in major problems.
