التنظيم القانوني للحقوق المجاورة لحق المؤلف

Résumé: ملخص: الحقوق المجاورة لحق المؤلف هي الحقوق الخاصة بالاشخاص الذين تدور أعمالهم في فلك استغلال المصنف الادبي أو الفني والمترتبة لهم بناء على الدور الذي نفذوه فيه، ولكن مع التطورات السريعة في مجال التكنولوجيا وظهور امكانيات التسجيل ووسائل الاذاعة اللاسلكية وظهور التوابع الصناعية، أصبح من المستحيل اعتبار دور هؤلاء الاشخاص منتهيا بمجرد انتهائهم من اداء ادوارهم. لذلك أصبح من المنطقي الاهتمام بهذه الفئة وإقرار حماية قانونية لاصحاب الحقوق المجاورة باختلاف فئاتها سواء من حيث الاداء أو الانتاج، أو البث. لذلك سنقوم من خلال هذه الورقة البحثية بتحديد أصحاب الحقوق المجاورة لحق المؤلف والحقوق الممنوحة قانونا لكل فئة منهم، وهذا للأهمية الواسعة والكبيرة التي حظيت بها هذه الفئة ضمن حقوق الملكية الفكرية لما لها من دور إيجابي في تقدم مستوى الابداع الأدبي والفني. كلمات مفتاحية: الملكية الفكرية، الاذاعة ، التلفزيون، التكنولوجيا، الابتكار. Abstract: Rights related to copyright are the rights of the persons whose works revolve around the sphere of exploitation of the literary or artistic work and which are entailed for them based on the role they carried out in it .Persons are terminated as soon as they finish their roles. Therefore, it became logical to pay attention to this category and to establish legal protection for the owners of neighboring rights in all its categories whether in terms of performance, production or broadcasting. Therefore, through this research paper, we will identify the owners of the rights neighboring to copyright and the rights granted legally for each category of them, and this is due to the wide and great importance that this group has within intellectual property rights because of its positive role in advancing the level of literary and artistic creativity.
