الوضع القانوني لشركة فاغنر في النزاع المالي على ضوء قواعد القانون الدولي

Résumé: ملخص: باتت الشركات العسكرية والأمنية الخاصة جزء لا يتجزأ من الحروب الحديثة خاصة في الدول الهشة، فهي تقاتل جنبا لجنب مع القوات المسلحة النظامية، مثلما حدث في جمهورية مالي، والتي لم تجد مخرجا من الأزمة الأمنية، غير الاستعانة بهذه الكيانات، التي مزال يحوم حولها نوع من الغموض في القانون الدولي، نظرا لنوعية الخدمات المقدمة خاصة في ما يخص التدخل المباشر في العمليات القتالية، فتحديد الوضع القانوني لهذه الكيانات عند دخولها كطرف في النزاع أمر ذا أهمية خاصة، إذ يختلف مركزها القانوني حسب الجهة المتعاقد معها ونوع النزاع المسلح، لذا تم تحديد قواعد القانون الدولي المطبقة لتبيان مدى مشروعية العقود التي تبرمها، وكذا تصنيف موظفي الشركة إذ يختلف وضعهم من مقاتلين إلى مرتزقة إلى مدنيين، بحسب الوظائف المسندة إليهم، ونوع النزاع المسلح، والطرف المتعاقد معه. Abstract: Private military and security companies have become integral part of contemporary armed conflicts; especially in weak states. These companies fight alongside the regularly army, that’s the case in the Republic of Mali, which did not find a way out to overcome its security crisis, other than concluding a deal with these entities whose legal state is still unknown in the international law. The current state of the regulation in the matter of PMSCs is linked to the type of the services they provide; especially actions relating to direct involvement in offensive combat. Determining the legal status of these companies, when acting as a part in a conflict, is pretty important. However, their legal status varies according to the contractor and to the type of the armed conflict, that’s why the rules of international law have been determined and applied in order to show the legality of the contracts concluded, as well as the classification of the company’s employees; besides, their status varies from fighters to mercenaries to civilians, according to the tasks they carry out, to the type of the armed conflict and the contractor.
