التحقيق في مخالفات المنافسة في القانون الجزائري

Résumé: تعتبر مرحلة التحقيق في مجال المنافسة الذي تباشره أشخاص حددها الأمر رقم 03-03 المعدل والمتمم أحد المراحل المهمة التي تمر بها إجراءات المتابعة، كونه يتعلق بإثبات مخالفات المنافسة المتعلقة بالممارسات المقيدة للمنافسة وكذا التجميع الإقتصادي غير المرخص به، وبالرغم من أن تشريع المنافسة قد إحتفظ في بعض جوانبه بالطابع القمعي إلا أن النظام العام للتحقيق يغلب عليه الطابع المدني في إشارة إلى التخلي عن جانب معتبر من الإجراءات الجزائية في هذا الإطار أو على الأقل تقل حدته لغاية أرادها المشرع، بعد أن كانت من إختصاص القضاء الجزائي قبل أن ينقل إختصاص قمعها لمجلس المنافسة حصرا بعد سنة 1995. The period of investigation in the field of competition conducted by persons specified in Ordinance No. 03-03, amended and supplemented, is one of the important stages that follow-up procedures go through, as it relates to establishing practices restricting competition as well as unauthorized economic assembly, although competition legislation has retained in some aspects of its character. However, the general system of investigation is predominantly civil in nature, in reference to the abandonment of a significant aspect of the penal procedures in this context, or at least its intensity reduced to the purpose of the legislator, after it was within the jurisdiction of the criminal judiciary before the jurisdiction of its suppression was transferred to the Competition Council exclusively after 1995.
