إشكالية المصطلح في قانون المنافسة الجزائري: ممارسات مقيدة أو منافية للمنافسة؟

Résumé: إن المطلع على الأمر رقم 03-03 المتعلق بالمنافسة سيصطدم منذ الوهلة الأولى بإشكالية المصطلح؛ إذ أطلق المشرع الجزائري وصف الممارسات المقيدة للمنافسة على الممارسات الواردة في الفصل الثاني من الباب الثاني لهذا الأمر، وبالتالي يكون قد وقع في خطأ خاصة أن الوصف الأخير يعبر عن صنف آخر من الممارسات التي نظمها بدوره ضمن أحكام القانون رقم 04-02 المحدد للقواعد المطبقة على الممارسات التجارية، علما أنه في ظل القانون السابق للمنافسة، أي الأمر رقم 95-06 المتعلق بالمنافسة (الملغى)، كان قد وصف الممارسات الواردة فيه بـ الممارسات المنافية للمنافسة. تعد هذه الدراسة محاولة لدراسة هذه الإشكالية والبحث في المعنى اللغوي والاصطلاحي لكل من تقييد المنافسة والتنافي معها مع إبراز خصوصيات ومميزات نوعي هذه الممارسات وذلك بالاستعانة بموقف الفقه والتشريعات المقارنة وكذا رأي مجلس المنافسة. وقد خلصت هذه الدراسة إلى نتيجة مفادها أن المصطلح الأنسب لوصف الممارسات التي نظمها الأمر رقم 03-03 هو الممارسات المنافية للمنافسة. At the very first glance over ordinance no. 03-03 related to competition, one will face a terminology problem, as the Algerian legistrator described the practices that mentioned in it as competition-restrictive practices instead of anti-competitive practices as it used to be termed in the previous ordinance no. 95-06 related to competition, given that the restrictive practices are a different type of practices that is regulated by act no. 04-02 setting the rules applicable to commercial practices. This article is an attempt to examine this problem by investigating the linguistic and terminological meanings and highlighting the characteristics of these two terms, supporting that with some comparative competition laws and the opinion of Algerian competition council on the matter. This study concluded that the most appropriate term to describe the practices regulated by Ordinance No. 03-03 related to competition is the anti-competitive practices.
