سلطة الإدارة في فرض جزاءات على المتعاقد معها

Résumé: ترتبط العقود الإدارية بتسيير المرافق العامة، فمن أجل ضمان سير هذه المرافق بانتظام واضطراد تم منح الإدارة سلطة تمكنها من ضمان تنفيذ العقد الإداري وهي سلطة توقيع جزاءات إدارية بنفسها على المتعاقد معها، وهذا ما يجعل العقود الإدارية تتميز عن عقود القانون الخاص، لكون أن هذه الأخيرة لا يوجد فيها مثل هذه الجزاءات. Administrative contracts are related to public utilities management, so in order to ensure the regular and steady functioning of these facilities, the administration has been empowered and granted authority to ensure the fulfilment or the enforcement of the administrative contract. That authority allows the administration to apply administrative penalties on the contracting party. This what makes administrative contracts different from private law contracts, where there are no such penalties.
