الاختصاصات الاستثنائية المخولة لجهات المتابعة والتحقيق بشأن جرائم الفساد في القانون الجزائري

Résumé: ملخص : أهم ما يميز جرائم الفساد هو الطابع الخاص والمعقد، لذلك خص المشرع جهات المتابعة والتحقيق باختصاصات استثنائية عندما يتعلق الأمر بجرائم الفساد، سواء في القانون الخاص بالوقاية من الفساد ومكافحته لسنة 2006، أو في قانون الإجراءات الجزائية، لما لهذه الاختصاصات الاستثنائية من أهمية في الكشف عن جرائم الفساد وتعقب مرتكبيها، لجمع الأدلة اللازمة بشأنها. والإشكالية التي يثيرها موضوع هذه الدراسة، تتعلق بالبحث في مدى فعالية هذه الاختصاصات الاستثنائية، في تعقب مرتكبي جرائم الفساد وكشف الحقيقة بشأنها. وللوصول إلى الإجابة على هذه الإشكالية، تم التطرق في هذا المقال إلى الاختصاصات الاستثنائية المخولة لجهات المتابعة والتحقيق بشأن جرائم الفساد المنصوص عليها في قانون الإجراءات الجزائية، وإلى الاختصاصات الاستثنائية المنصوص عليها في القانون الخاص بالوقاية من الفساد ومكافحته. Abstract: The most important characteristic of corruption crimes is the special and complex nature. Therefore, the legilator singled out the follow-up and investigation bodies with exceptional prerogatives when it comes to corruption crimes. Whether in the law on the Prevention and Combating Corruption Act of 2006, or in the Code of Penal Procedure, because of the importance of these exceptional prerogatives in detecting and tracking the crimes of corruption and its perpetrators, to gather the necessary evidence on them. And the problem raised by the subject of this study concerns the examination of the effectiveness of these exceptional prerogatives in tracking down the perpetrators of corruption crimes and uncovering the truth about them. And to get to the answer of this problem, This articule discusses the exceptional specialities authorized to the follow-up and investigation authorities about the corruption crimes stipulated in the Code of Penal Procedure, and the exceptional prerogatives stipulated in the special law on prevention from corruption and combating it.
