بث الشفافية في مسار إبرام عقود تفويض المرفق العام -دراسة في ضوء المرسوم التنفيذي 18-199-

Résumé: تهدف هذه الورقة البحثية إلى تقصي مدى بث الشفافية في مسار إبرام عقود تفويض المرفق العام هو إبراز مدى تضمين المرسوم التنفيذي 18- 199 -بإعتباره تنظيما إجرائيا- النصوص الكفيلة بنقل شفافية إجراءات تفويض المرفق العمومي من التقنين إلى التمكين، والوقوف على الإستثناءات المضيقة لها في ظل الضمانات الإدارية والقضائية المكرسة لمبدأ الشفافية. سعى المرسوم التنفيذي 18-199 إلى إضفاء الشفافية في طرق إبرام عقود تفويض المرفق العام وإجراءاتها عن طريق تكريس الإعلان والعلانية من جهة وخلق ضمانات إدارية داخلية وخارجية من جهة أخرى، اضافة الى دور القضاء الإستعجالي في إضفاء الحماية القضائية للمبدأ. Abstract: This paper aims to explore the extent to which transparency is promoted in concluding public service delegation contracts and to highlight the extent to which executive decree 18-199, as a procedural regulation, contains provisions to shift the transparency of public service delegation procedures from regulation to empowerment, as well as to address its exceptions under the administrative and judicial guarantees enshrining the principle of transparency. The executive decree 18-199 sought to provide transparency in the methods and procedures for concluding public service contracts by, on the one hand, devoting announcement and publicity and, on the other hand, creating internal and external administrative guarantees, as well as the role of emergency jurisdiction in giving judicial protection to the principle
