Résumé: الملخص من المقاصد الشرعية للزواج اشتراط الوالي في عقد زواج المرأة ولو راشدة، هذا ليس من باب التضييق على حريتها ولا من باب سلب و إهانة كرامتها بل هو صيانة لها مما يشوبها، وشرط الولي في عقد زواج المرأة الراشدة هو أن الشروط الهامة التي كثر عليها الكلام وكثر فيها الخلاف حسب الفقهاء والشريعات، فمنهم من أكد دوره ورتب على تخلفه بطلان العقد، ومنهم من جعل منها مثل الرجل تتصرف في نفسها كما تشاء من دون أي تعقيب عليها من أحد، ولعل المشرع الجزائري بتخليه عن الولاية قد ساهم في نشر تفكك الوحدة الأسرة، ولكن رغم الاختلاف التوجهات والأهداف إلا أن الوالي تبقى له المكانة الأسمى في حياة المرأة، فهو السند والحامي لها.
