الضوابط القانونية للتلقيح الاصطناعي في التشريع الجزائري دراسة نظرية على ضوء القانون الجزائري

Résumé: الملخص نظرا لعدم كفاية الطرق الطبيعية في التلقيح لتحقيق غاية الإنجاب لدى من به عقم فقد اقتضت الضرورة إيجاد طرق بديلة تلبي هذه الغاية ، وذلك ما أدركه العلماء بالفعل عن طريق تطوير ما يعرف بالتلقيح الاصطناعي، والذي أصبح خيارا أمثلا لتحقيق الإنجاب ونتيجة لضرورته وأهميته الكبيرة رغم ما يشوبه من مفاسد ومحاذير شرعية سعينا من خلال هذه الدراسة إلى تحديد مفهومه من خلال تعريفه وتبيان موقف الشريعة الإسلامية والمشرع الجزائري منه، وتحديد ضوابطه وشروطه، وكذا بيان أحكامه وعلى وجه خاص حكم استئجار الأرحام و بنوك الأجنة في التشريع الجزائري بين الأخلاقيات والجزاءات المقررة بموجب القانون رقم 18-11 والمتضمن قانون الصحة. Abstract : Due to the insufficiency of natural methods of insemination to achieve the goal of childbearing among those with infertility, it was necessary to find alternative methods that meet this goal, and this is what scientists have already realized by developing what is known as artificial insemination, which has become an ideal option for reproduction and as a result of its necessity and its great importance despite its imbalance of Evils and legal prohibitions we sought through this study to define its concept by defining it and clarifying the position of Islamic sharia and the Algerian legislator towards it, defining its controls and condition, as well as explaining its provisions, and in particular the ruling on surrogacy and embryo banks in Algerian legislation between ethics and penalties established under law no:18-11 included Health cod.
