تسوية النزاعات البيئية في إطار المحاكم القضائية الدولية

Résumé: إن النزاعات الدولية البيئية لها تأثيرات وخيمة على البيئة والتنمية المستدامة من جهة، وعلى الأمن والسلم الدوليين من جهة أخرى، ، لذا وجب العمل على التسوية السلمية لهذه النزاعات بعيدا عن استخدام القوة أو التهديد ويعد ذلك من أسمى المقاصد التي يسعى المجتمع الدولي إلى تجسيدها على أرض الواقع. نظرا لحاجة المجتمع الدولي إلى الاستقرار والآمان من خلال التقليل من حدة النزاعات التي تنشأ بين الدول مهما كانت طبيعتها، كان لازما من وجود مبدأ التسوية السلمية للنزاعات الدولية، من هذا المنطلق يعتبر القضاء الدولي المتمثل في المحاكم الدولية على اختلافها عامة كانت أو خاصة من بين أهم الآليات التحاكمية لتسوية النزاعات البيئية، وتعتبر القضايا المعروضة بهذا الشأن أمام هذه المحاكم خير دليل على أهمية هذه الآليات وفعاليتها في مجال تسوية النزاعات البيئية. international Environmental conflicts have disastrous effects on the environment and sustainable development on the one hand, and on international peace and security on the other hand. Therefore, it is necessary to settle these conflicts peacefully away from the use of force or the threat of it, as one of the highest objectives that the international community seeks to realize in reality. Regarding the international community’s need for stability and security by reducing the intensity of conflicts that arise between countries of whatever nature, it was obligatory to create the principle of peaceful settlement of international disputes, from this standpoint, the international judiciary represented in international courts in their various forms, whether public or private considered among the most important judicial mechanisms for settling environmental disputes. Moreover, the cases presented in this regard to these courts are the best evidence of the importance of these mechanisms and their effectiveness in the field of settling environmental disputes.
