مكافحة جرائم المخدرات بين الشريعةالاسلامية والقانون الجزائري

Résumé: شرف االله سبحانه وتعالى الإنسان بالعقل على بقية المخلوقات حتى يعقل عنه شرائعه التي بعث بها رسله ] عليهم الصلاة و السلام أجمعين [، ليخرجوا بها الناس من الظلمات إلى النور، ومن الضلالة إلى الهدى، ومن الحيرة إلى الصراط المستقيم، وهذا لفضل نعم االله في الحياة وهو العقل والمحافظة عليه من مقاصد الشريعة الإسلامية والمتمثلة في جلب المصالح ودرء المفاسد، وتحريم كل ما من شأنه تعطيل العقل سواء من صاحب العقل أو في شتى الصور المساهمة في تعطيله، كتعاطي الخمور والمخدرات التي لها أثر في تغييبه فنصت عليها عقوبات رادعة للجاني ولجميع الأمة، فالمخدرات محرمة شرعا في ذاتها وجميع ما تتصل به. وهذا ما انتهجه المشرع الجزائري بسنه القانون 18/04المتعلق بالوقاية من المخدرات والمؤثرات العقلية وقمع الاستعمال والاتجار غير المشروعين بها، والذي اتسم بالصرامة وتشديد العقوبة، كما أن التشريع الإسلامي والجزائري أرجع في الحد من الجريمة بالوقاية قبل وبعد الجريمة، والعلاج الذي يعرف بالسياسة الإصلاحية بالتوازي مع السياسة العقابية في إطار مساهمة مكافحة جرائم المخدرات، والتي تدخل ضمن السياسة الجنائية. Allah the Almighty has honored the human by mind to the rest of creatures to comprehend his laws which sent by his messengers peace be upon them, to get out the people from darkness to light, and from misguidance to guidance, and from the bewilderment to the straight path, and this by preferred Allah’s graces in life and it is the mind and maintain it of the purposes of Islamic law and represented by bringing benefits and ward off evil and the prohibition of anything that would disrupt the mind or in various ways that contribute to disable it, such as the abuse of alcohol and drugs which have an impact in absent the mind by stipulating deterrent penalties on the offender and to all the nation, drugs is ungodly and all are connected with. And this as pursued by the Algerian legislator by enacting the law 04/18 on the prevention of drug and Psychotropic Substances and the suppression of the use and illicit trafficking, which was characterized by strict, and severe punishment , also, Islamic legislation and Algerian is swage in reducing crime by the prevention before and after the crime and the treatment, which is Known the reformist policy in parallel with the penal policy as part of a contribution in the fight against drug offenses
