الرّقابة على أسلوب الامتياز كنمط لاستغلال الأراضي الفلاحية في الجزائر

Résumé: الملخص: لقد وضع المشرع الجزائري بموجب القانون رقم 10-03 إطارا قانونيا لعقد الامتياز الفلاحي، باعتباره نمطا جديدا وحيدا لاستغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة وبغرض حماية هذه الأراضي من التصرفات الواقعة عليها من طرف المستثمر صاحب عقد الامتياز وخاصة تغيير وجهتها الفلاحية، منح القانون للديوان الوطني للأراضي الفلاحية وبعض الصناديق الخاصة سلطات واسعة في المراقبة الدورية لهذه المستثمرات، وحماية الأراضي من كل التصرفات المخلة بقيمتها ومردوديتها وتطويرها، وتحرير كل المخالفات التي تنجم عن الإخلال بالالتزامات العقدية التي قد تؤدي إلى الفسخ الإداري واسترجاع الأراضي محل عقد الامتياز الفلاحي، إضافة إلى الحماية الجنائية طبق للقانون رقم 08-16. Abstract : The law granted the National Agricultural Land Office and certain private funds broad powers to periodically monitor such investments and protect agricultural land against any act detrimental to its value and development of all offenses resulting from breach of contractual obligations which may lead to the cancellation of the concession contract and the recovery of the land subject to the agricultural concession contract, In addition to the criminal protection provided for the lands subject to this contract, certain offenses are criminalized within the meaning of Law no. 08-16 on the Agricultural Directive.
