Résumé: الشهادة وسيلة من وسائل تحقيق الدعوى الإدارية تعتمد على شخصية وأحاسيس ومعتقدات الشاهد.ومما لا شك فيه أن لشهادة الشهود دورا كبيرا في مجال الإثبات، ولاسيما الإثبات الجنائي والمدني، فضلا عن دورها في مجال الإثبات الإداري. لقد خلص معظم فقهاء القانون الإداري إلى أن الدور الرئيسي في الإثبات الإداري يكون للكتابة، و أن دور الشهادة دور تكميلي حين يتعذر الدليل الكتابي إلا أنهم لم ينفوا إمكانية استخدام الشهادة بما يتفق و طبيعة الدعوى المعروضة ودور القاضي الإداري فيها كلما أمكن ذلك،إذ يلعب القاضي دورا تقديريا واسعا إزاء الإثبات بشهادة الشهود، وهذا الدور يتجلى في كافة مراحل هذا الدليل، حيث يحظى القاضي بسلطة كبيرة في إعمال تقديره وقناعته لقبول الإثبات به وكذلك في إجرائه وتقديره لتلك الأقوال وهو ما نحاول إلقاء الضوء عليه في إطار هذه الدراسة. Undoubtedly, witness testimony plays a major role in the field of proof, especially in criminal and civil evidence, as well as in administrative evidence Most of the jurists of administrative law concluded that the main role in administrative proof is to write, and that the role of the certificate is complementary when the written evidence cannot be denied, but they did not deny the possibility of using the certificate in accordance with the nature of the case and the role of the administrative judge where possible, The judge has a wide discretionary role in proving evidence of witnesses, and this role is reflected in all stages of this guide. The judge has great authority in exercising his discretion and his conviction to accept the evidence and to conduct and evaluate these statements studying
