آليات تطبيق مبدأ الحيطة في القانون الدولي للبيئة

Résumé: أصبح مبدأ الحيطة منذ سنوات موضوعا مثيرا للجدل، وحقق دورا بارزا في الخطاب الدولي للقانون والسياسة البيئية. ويتضمن المبدأ بأن غياب المعرفة العلمية الكاملة لا يجب أن يكون سببا لتأخير اتخاذ تدابير فعالة من حيث التكلفة لمنع ضرر محتمل خطير لا رجعة فيه تسببه ظاهرة أومنتج أونشاط، على الرغم من اتهامه بشل روح الاختراع والابتكار الضروريين من أجل التقدم، من بين انتقادات أخرى. وتهدف هذه الدراسة إلى تسليط الضوء على هذا الجدل بإظهار أن المشكلة تكمن في تقييم المخاطر التقنية وإدارتها والتواصل حولها، وكذا مشكلة قيمته القانونية (القيمة الشارعة له)، عن طريق تعريف المبدأ والشروط التي تجعل منه قابلا للتطبيق، تفعيله، التحقيق في الآثار المترتبة عن هذا التطبيق، وتوضيح نطاقه القانوني في القانون الدولي العام، قصد ترشيد صنع القرار لمواجهة التعقيد وعدم اليقين في إدارة المخاطر البيئية. ...................................................................................................................................................... Precaution has been for years a controversial issue, and has attained a prominent role in the international discourse of environmental law and policy. It includes that lack of full scientific knowledge should not be used as a reason to postpone cost-effective measures to prevent potentially serious and irreversible harm caused by a phenomenon, product, or process; although the principle is accused of paralyzing the spirit of invention and innovation necessary for progress, and other critics. The purpose of this study is illuminate this debate by demonstrating that this is a problem of technical risk assessment; its management and its communication; and the problem of its statute (normative value), by defining the principle and the conditions of its applicability and its implications; and to clarify the legal scope in general international law, in order to rationalize decision-making to cope with complexity and uncertainty in environment risk management.
