خصوصية التجريم والعقاب في الجرائم الواقعة على الأصول في التشريع الجزائري

Résumé: لقد استفحلت في الآونة الأخير ظاهرة الجريمة ضد الأصول في المجتمع الجزائري المحافظ في صمت، التي كان لها آثارا وخيمة على استقرار الأسرة الجزائرية، وعلى هذا الأساس سارع المشرع الجزائري إلى شرعنة عديد النصوص القانونية والتدابير الإجرائية لقاء مجابهة هذه التصرفات المشينة. إن النظام القانوني القاضي بتجريم الممارسات في مواجهة الأصل الشرعي (المجني عليه) تتسم بالخصوصية التجريمية والتي أسهمت في تشديد النمط العقابي على شخص الفرع الشرعي (الجاني)، على كل عمل من شأنه استهداف الأصل الشرعي جسديا أو ماليا أو معنويا، هي تدابير من شأنها حماية الأسرة الجزائرية وقيمها الأخلاقية التي بصلاحها يصلح المجتمع. The phenomenon of crime against assets in the conservative Algerian society has recently increased in silence, which had dire effects on the stability of the Algerian family, and on this basis the Algerian legislator hastened to legitimize many legal and procedural texts in order to confront these disgraceful behaviors. The legal system that criminalizes practices in the face of the legitimate origin (the victim) is characterized by criminal specificity, which contributed to tightening the punitive pattern on the person of the legitimate branch (the offender), on every act that would target the legitimate asset physically, financially or morally, are measures that protect The Algerian family and its moral values, which are good for society.
