جريمة ترك مقر الأسرة في التشريع الجزائري

Résumé: تستهدف هذه الورقة البحثية موضوع جريمة ترك مقر الأسرة المنصوص عليها بموجب المادة 330 من قانون العقوبات الجزائري، كونها من الجرائم الواقعة على نظام الأسرة، وذلك باعتبار الرابطة الأسرية معيارا بارزا في مجال التجريم، ومن ثم يشكل ترك أحد الوالدين لمقر الأسرة والتخلي عن الالتزامات العائلية الملقاة على عاتقه دون سبب جدي من أكثر ما تتعرض له الأسرة من أفعال يمكن أن تمس بكيانها و أمنها وتهز استقرارها. ولقد خص المشرع الجزائري الأسرة بحماية خاصة من مخاطر هذه الجريمة نظرا لأهميتها في بناء المجتمع والدولة معا وذلك رغم بعض النقائص المسجلة في هذا المجال، والتي يتوجب على المشرع تداركها مستقبلا عن طريق صياغة جديدة للنصوص القانونية المتعلقة بها بما يتلاءم وخصوصية الأسرة وبنية المجتمع من جهة، وبما يحفظ لها كيانها وتماسكها واستمرارها من جهة ثانية. This research paper targets the crime of leaving the family’s residence that stipulated under the Article 330 of the Algerian Penal Code, as being a crime on the family system, and considering the family bond as a main criterion in the field of criminalization . Hence, leaving one of the parents to the family’s residence and abandoning without a serious reason may harm the family security and stability. The Algerian legislator protected the family from this crime due to its value in the society and the state , despite some defects noted. Thus the legislator must rectify it via new formulation of the legal texts in a manner consistent with the privacy of the family, the structure of the society, And preserve the family cohesion and continuity.
