ردع عصابات الأحياء وفقا للقانون 20-03 المؤرخ في: 30أوت2020 والمتعلق بالوقاية من عصابات الأحياء ومكافحتها -دراسة تحليلية-

Résumé: الهدف من هذا الموضوع هو؛ دراسة مدى نجاعة الجزاءات والآليات التي تناولها المشرع من خلال القانون رقم20/03 في مكافحة عصابات الأحياء على المستويين المحلي والوطني، من خلال تحليل النصوص الواردة في هذا القانون؛ من حيث المفاهيم وآليات الوقاية والردع. ولقد تدرج المشرع الجزائري من حيث تشديد العقوبات الموقعة على مرتكبي جرائم عصابات الأحياء حسب خطورة وجسامة كل فعل من الأفعال المكونة لهذه الجرائم، حيث تبدأ في صورة أفعال بسيطة عقوبتها الحبس ثم تتدرج إلى جرائم تصل عقوبتها إلى حد السجن المؤبد. TThe objective of this topic is; Studying the efficacy of the penalties, methods and mechanisms addressed by the legislator through Law No. 20/03 in combating neighborhood gangs at the local and national levels, by analyzing the texts contained in this law; In terms of concepts and mechanisms of prevention and deterrence. The Algerian legislator has graded in terms of tightening the penalties imposed on the perpetrators of neighborhood gang crimes according to the seriousness of each of the acts constituting these crimes, as they begin in the form of simple acts punishable by imprisonment and then progress to crimes that reach the penalty of life imprisonment
