المسؤولية الجنائية عن الجرائم الماسة بالبيئة الطبيعية، دراسة على ضوء التشريع الجزائري

Résumé: ملخص: يسلط هذا البحث الضوء على أهم الأسس القانونية لتحميل المجرم البيئي المسؤولية الجنائية عن الانتهاكات التي يرتكبها في حق البيئة الطبيعية في ظل أن القانون الجنائي البيئي لايزال غير مقنن وغير مستقر بشكل كامل، ومن هم الأشخاص المخولون لتحمّلها. وفي الحقيقة نجد أن المشرع الجزائري قد نظّم مجال المسؤولية الجنائية تنظيما يمكن إلى حد بعيد الاعتماد عليه في عقاب المجرم البيئي الذي توصلنا إلى أنه يمكن أن يكون شخصا طبيعيا مسؤولا مسؤولية شخصية أو مسؤولا عن أفعال غيره، ويمكن أن يكون شخصا معنويا أهلا لتحمل المسؤولية. Abstract: This research sheds light on the legal basis for holding the environmental criminal responsible for environmental violations, especially that the environmental criminal law is still not codified and not fully stable, and who are the persons authorized to bear it. In fact, we find that the Algerian legislator has regulated the field of criminal responsibility, an organization that can be relied upon to a large extent in punishing the environmental criminal, who we have concluded that he could be a natural person responsible for personal responsibility or responsible for the actions of others, and he could be a legal person qualified to assume responsibility
