الرقمنة آلية لتعزيز حق التقاضي

Résumé: يعتبر الحق في التقاضي من أهم الحقوق المكرسة في الدساتير والمواثيق الدولية والاقليمية باعتباره ضامنا للحقوق والحريات الأخرى، فبدون تمكين الأفراد من اللجوء إلى القضاء لحل نزاعاتهم واسترجاع حقوقهم المهضومة تفقد كل الحقوق قيمتها وأهميتها، غير أن إعمال حق التقاضي يقضي توفير مجموعة من الضمانات من أبرزها تبسيط إجراءات التقاضي، ولا يكون ذلك إلا عن طريق عصرنة قطاع العدالة، بإدخال واستعمال التكنولوجيا الحديثة ( رقمنة قطاع العدالة)، بما يكفل ضمان استقلالية القضاء، وتسهيل اللجوء إليه بإجراءات قضائية أكثر مرونة وبساطة، وضمان المصداقية في الفصل في النزاعات في آجال معقولة بما يضمن توثيق الصلة بين فعالية العدالة واحترام حقوق الإنسان The right to litigation is one of the most important rights enshrined in international and regional constitutions and charters as a guarantor of other rights and freedoms.
